In early October 2013, British Petroleum (hereinafter "BP") had success in the 5th Circuit Court of Appeals in its appeal related to the criteria for "matching" monthly profit and loss statements specifically relating to revenue and variable expenses. The decision of the 5th Circuit will potentially affect over 175,000 Business Economic Loss (BEL) claims and interrupts the cash flow of all claims preparers and the claimants that they represent. BP also recently presented a motion to challenge the Administrator of the DHECC and raise questions regarding determination of causation beyond the financial tests specified in the Settlement Agreement.

In the absence of agreement between BP and the PSC, Judge Barbier, to whom the 5th Circuit remanded the case, directed the Administrator to stay all BEL claims and evaluate them for appropriate “matching”. Judge Barbier ordered the Administrator then to continue processing and payment of only those claims that sufficiently met criteria established by Administrator Juneau in his October 25th Declaration that set out certain tests.

The Fairness Hearing on November 8, 2012 confirmed that the Deepwater Settlement Authority is here to stay and claimants are being paid! During the Fairness Hearing, Patrick Juneau, Settlement Administrator announced that the claims facility has received 79,008 claims from 62,000 claimants; of those, over 36,000 claims were approved for over $1.3 billion dollars with approximately 95% of those claimants accepting payment offers in line with the terms in the Settlement Agreement.

“There was never much concern from our clients that Judge Barbier would stand tall and stick to his guns with the Settlement Agreement. Many of our clients got significant payment offers over the last few months from the DWHS which strengthened their position that this was a green light. However, the shadow of a doubt was in the minds of a select group of prospective clients as to what they would do if the Fairness Hearing went differently. The objectors who sought to ‘Opt Out’ of the Settlement Agreement to reach potentially more favorable terms were disappointed when they were advised that Judge Barbier and the Plaintiff’s Steering Committee had no plans of deviating from the 1033 page Settlement Agreement which was designed to accommodate all parties to the suit. Much to the disappointment of objectors to the historic Settlement Agreement, U.S. District Judge Carl Barbier and attorneys for both BP and plaintiffs seemed upbeat and positive at the November 8th Fairness Hearing in New Orleans.
