The Fairness Hearing on November 8, 2012 confirmed that the Deepwater Settlement Authority is here to stay and claimants are being paid! During the Fairness Hearing, Patrick Juneau, Settlement Administrator announced that the claims facility has received 79,008 claims from 62,000 claimants; of those, over 36,000 claims were approved for over $1.3 billion dollars with approximately 95% of those claimants accepting payment offers in line with the terms in the Settlement Agreement.
“There was never much concern from our clients that Judge Barbier would stand tall and stick to his guns with the Settlement Agreement. Many of our clients got significant payment offers over the last few months from the DWHS which strengthened their position that this was a green light. However, the shadow of a doubt was in the minds of a select group of prospective clients as to what they would do if the Fairness Hearing went differently. Thankfully, everything went the way that everyone was hoping and we are Full Steam Ahead now!” said Craig Sienema, VP of Operations for IT Strategies Group and the OilClaim Calculator™.
The objectors who sought to ‘Opt Out’ of the Settlement Agreement to reach potentially more favorable terms were disappointed when they were advised that Judge Barbier and the Plaintiff’s Steering Committee had no plans of deviating from the 1033 page Settlement Agreement which was designed to accommodate all parties to the suit. Much to the disappointment of objectors to the historic Settlement Agreement, U.S. District Judge Carl Barbier and attorneys for both BP and plaintiffs seemed upbeat and positive at the November 8th Fairness Hearing in New Orleans. In an atmosphere far from antagonistic, both sides praised the other about the professionalism with which the parties negotiated the Settlement Agreement.
